When speaking about liability, many seem to forget the initial meaning of the word, which would let them understand better anything that has to do with “liability” in this country. “Liability” means that “there’s a possibility” if used in broader terms. In legal glossary, liability tends to be associated with words “owing” and “responsibility” meaning that a person or entity is forced to hold responsibility for certain actions with respect to the legal framework of the state or federal level. The same meaning spreads to the field of insurance too.

In most cases, such a responsibility has a financial form when a condition or a situation putting the law at work takes place. This is because laws are designed to regulate the lives of all citizens, harmonizing all relations between them and assuring that any injustice is addressed properly.

In most US states and countries over the world, drivers are legally required to carry insurance policies when operating most types of vehicles, which of course includes cars as well. And as there are many conditions for the driver to be responsible for certain damage or injury on the road, all insurance policies include a “liability” section, which is triggered in situations of being at fault during a traffic accident.

When a traffic accident takes place, someone is the victim and someone is at fault. Who’s who is determined by the police basing upon the facts provided by both parties, witnesses and location observations. All parties involved in the accident should have auto insurance in order to drive a car legally. And the one who is determined to be at fault is automatically liable for the damages caused by his or her actions on the road. Meaning that the person wields financial responsibility for the consequences of the traffic accident and the insurance policy will help the person pay for the damages or injuries done.

Most people driving cars don’t have the money to be fully liable for any accident they are involved in, because repairing a car or paying medical bills can cost you a fortune. That’s why people need insurance policies when driving automobiles and no matter whether you have cheap auto insurance or a very costly coverage plan, your policy still contains the liability portion to different extents.

The cost of your insurance policy does not determine the amount of liability it carries directly, but usually the more costly is the policy the larger is the amount of liability coverage. Still, you can have decent liability coverage even with cheap auto insurance plans if you look deeper into your options and choose the right offer from the right provider.

Just make sure to ask your agent or broker about your liability limits before buying the actual policy. The state you live in can strongly influence the minimum amount of coverage to be carried, because these numbers vary across states. And you don’t want to have liability coverage below the required minimum, because it will cause much trouble when the policy finds it out.

Having an accident with a driver who has no auto insurance coverage can place you and your insurance company in an unpleasant situation. However, having uninsured/underinsured motorist coverage allows you to rest assured that you’ll receive coverage no matter what. While having an accident with such a driver may sound quite unlikely, since all states legally require drivers to have auto insurance, fact is that there the number of uninsured drivers can go up to 25% in certain places.

What is UM or UIM?

Uninsured or underinsured motorist coverage will pay for injuries or damages you, your passengers or your property has sustained due to an accident with a driver who doesn’t have enough insurance coverage, or no insurance at all and is called responsible from the legal point of view.

By uninsured river most companies mean a driver who had no insurance, didn’t have the minimum required amount, or was denied coverage by his insurance company and thus being unable to pay for the damage caused. Hit-and-run drivers can also be classified as uninsured drivers from bodily injury liability perspective.

An underinsured driver in contrast, is a car owner who had the amount of coverage to meet state minimum requirements but not enough to cover the damage or injuries caused. In this case, his insurance will pay a certain part of the damage and the rest will have to be covered by underinsured motorist coverages.

Though, you have to keep in mind that these coverage types are not the same and are separate. Still, insurance companies tend to bundle them into a single product for convenience.

Is it a must?

Only in a small number of states UM/UIM coverage is legally required. The majority of states leave it as an option. However, if you choose to purchase this coverage it should meet the minimum state requirements but not exceed liability limits of your policy. In case your company offers uninsured motorist property damage (UMPD) coverage it is impossible to be purchased without having UMBI.

What use is there in it?

First of all, this type of coverage is relatively cheap car insurance and won’t boost up your rates dramatically. However, in case you have an accident with an uninsured/underinsured driver, you risk of not getting sufficient coverage by your company, which will pay for your car repair or medical bills if required. Assuming that the other party was at fault, it is the other party’s insurance company that should be paying for these expenses, and if there’s not enough or simply no coverage eventually you won’t be paid anything.

Having uninsured/underinsured motorist coverage will pay for your damages and injuries in case you face such a driver in an accident. It is evident that it’s better to have such coverage with your policy even if you are striving for cheap car insurance. You especially benefits from this coverage if you frequently drive in areas where there are more uninsured vehicles. See what the rates are in your location and decide if it is a must for you.

Sometimes life seems to be totally unfair. Let’s assume a situation where you became a victim of a car-related insurance fraud … you are down, what else can possibly happen to you? You pay! It is not only high premiums that you will have to pay, but also with your life, putting yourself and your family in danger. It is important to know how to deal with cases like this because we never know who might become the next insurance fraud casualty.

It all began back when the first car protection deal took place. Those incidents were recorded back in ancient Greece. Then fraud found its way and got to England and then to USA. When the world saw the first vehicle, the insurance fraud was taken to a whole new level. Nowadays car fraud have become hard to detect but don’t let yourself find this excuse and live with it. You can avoid being the next fraud victim.

To be able to avoid the scam you have to know how to detect it. There are many types of those. Sometimes, right when you thought it was a good deal with your car, it turns out you had been fooled. At times you feel like you can trust people when you really can’t. Most of the time people fall into these traps under some sort of influence. Usually most of us do trust doctors or lawyers. It happens not to be all so innocent.

Let us take a look at the list of mostly used scams:

Staged Rear-End Car Accidents: A prank driver will quickly get in front of an innocent car and then slam on their brakes. This causes the innocent driver to rear-end the scam driver. Along with collecting money for automobile damages, the prank driver will often fabricate medical injuries to collect even more money from his victim.

Adding Damage: After an accident the prank driver will cause his car even more damage and claim that the damages were caused by the innocent driver during the accident in order to collect more money

Fake Helpers: When it comes time to file the claim, the prank driver will deny getting anyone involved. They will offer keeping it quiet in order to solve the situation. Don’t forget the prank driver has others on his team. Those people will help him get more money from you – car reparation crew, doctors, lawyers and others.

In the world of today these scams could be waiting for us anywhere so it is important to be prepared. Awareness is what’s most important. Watch the other drivers on the road and make sure nobody is following you or trying to take a notice of your habits n the road. If the accident does happen please note all the details and keep the handy cam in the car with you in case you need to film or take pictures of the damages. It is wise to be protected. Auto insurance can guarantee you some sort of help, and sometimes the acknowledgment of that is what helps people stay confident, but please remember that no car insurance can save you from sly people that are looking for to a victim with a big wallet.

Despite the fact that car accidents are more mostly happening in the winter time, the things you have to manage afterwards an accident took place are never changing. Evidently it is difficult to think distinctly after turning out in an accident. Therefore it is significant to know in advance you turn out in a car accident what do you have to do first and what questions might be needed to be answered. This check list is meant to help you learn what you should do after you’ve got in a car accident. It is essential that you would look over it right away and then out-type it and retain a duplicate with you in your carrier.

Ascertain the degree of deterioration or harms

At first you should try to keep yourself calm and not to get nervous. Anxiety can definitely make others anxious and the event might get even worse. The situation has a need of a very unruffled individual to ascertain the degree of deterioration and to find out if there are any of the damages that require instant medicinal care.

Register an automobile accident statement with the police

Even in a very little accident it is very significant to make certain that there is a legitimate accident statement. You should not abandon the accident scene till a full statement is filed by police.

Talk over the automobile accident solely with the police

It might be difficult to prevent talking about what just only happened, with everyone all shook up, but that might also make you not pondering keen and promptly about what just occurred. It is essential to restrict your conversation of the accident and not to acknowledge any mistake or responsibility. You should be talking on the account of the accident with your insurance agent and the police solely.

Obtain the data

This is one is something most people know they have to manage, but frequently forget to after the car accident for one cause or the other. It is essential to obtain phone numbers, names, and address of everyone implicated in the particular automobile accident. A description of the vehicle and registration mark number might also be wholesome, but make certain you as well reach their auto insurance provider company and the vehicle authentication number of their auto. Don’t just suppose the registration mark number will be enough because most insurance underwriters are only recording the type of auto and the vehicle authentication number, not the registration mark number.

Phone your insurance provider

Phone your car insurance agent or company’s support number straightway, even at the accident scene with the police if it is probable. At times the police officer might give your auto insurance agent or company more specific and accurate kind of data rather than the data you might not be filing appropriately because you are really off-tuned by the automobile accident. This might be able to let you economize a lot of your precious time later, while you will be waiting for your claim to be handled.

The policy Kasko optional damage suffered by your car is usually expensive can be very useful for protecting new vehicles or high economic value. While the policy of liability insurance covers damage caused to third persons, the Kasko compensate those so-called “own”, that the damage sustained by your vehicle during the movement by road.

The validity of Kasko is not linked to the responsibility of the driver incidence: this means that you are entitled to compensation even if the accident was caused by the insured.

The Kasko is therefore to cover all the damages caused by others, for which no one can call into question the policy of any liability, such as those related to the reversal, after the collision of an exit road, or any other type of impact that may be suffered by the car during road. The coverage of this policy can be expanded even further, paying a premium even higher, to other types of events, such as damage caused by riots, revolts, officers of the police, weathering, and vandalism generics. Clearly, given the wide coverage it offers, this is a rather expensive bill, but still recommended for those who run a high risk of incidents not directly linked to collisions with other vehicles. So it’s a policy that is well suited to certain situations such as that of neo patentee who have not yet acquired sufficient experience in driving or in cases of very expensive vehicles, of which the damage can run as a separate, well in excess of the cost of a Kasko policy.

The Kasko can be of two types: Full Kasko covers all damages regardless of the liability of the insured, the mini Kasko covers only damage caused by accidents – demonstrable (must possess and provide the details) – with other vehicles but not those that occur to the vehicle alone (exit road for example).

The Kasko can have different levels of coverage: the maximum is the value Kasko that covers any damage caused by a movement of the vehicle, it provides limits of coverage and there is a threshold above which the damage excess is not compensated, as it happens instead for all other policyholders Kasko. In any damage could incur the vehicle with the absolute value Kasko during movement in the street, you will get a compensation, regardless of its size.

It covered all the events of movement, also unrelated to the collision with other vehicles are also included shock exit of the road, overturning. It is for this type of Kasko that can be inserted even damage caused by events not related to road traffic, which can then be determined by various causes. Can in fact make good the destruction or damage to the vehicle caused by events related to the crowd, such as riots, uprisings, the officers of the police. Moreover, they are covered under the insurance umbrella Kasko entire value also made generic vandalism against their vehicles.

Kasko this policy can compensate the damage caused to self by events or natural disasters, which may be volcanic eruptions, earthquakes, floods, hailstorms, tornadoes. The policy Kasko an integer value that is unique for this type of events can also restore up to the value of the insured vehicle. The driver, for compensation, must comply with all provisions of the Code of the Road and in general of the Italian lawyer. In case of serious violations of one or the other could not get compensation unless expensive signing of the exclusion clauses similar to redress policy liability.

The first absolute risk, however, provides a cap which does not take the value of the car. The first risk is similar because it provides a ceiling, but the value calculated on the value of the car.

Kasko bills at first risk for example through the imposition of an upper limit (ceiling) to compensation for damages that may be reimbursed by the left to their own vehicle, are a good compromise solution for the motorist want access to a type of insurance coverage Kasko value within the entire remaining affordable.

Policies Kasko a first risk can be of two types: the first bills to Kasko absolute risk and the policies Kasko a first relative risk, divided into two categories, depending on how you calculated the threshold below which must be guaranteed compensation. Kasko a bill in the first absolute risk calculation of the ceiling is made at the time of conclusion of the policy, outlining a market value of the vehicle. When signing puts you agree to a level of coverage, which will remain unchanged, regardless of the market value of the vehicle and it’s degraded year after year. Kasko first in a relative risk calculation for the ceiling instead we must make as a percentage of value of the car. E ‘a type of policy a little’ less expensive because it takes into account the devaluation of wear and that the vehicle suffers year after year. At this value represents the maximum percentage that the insurance will reimburse in the event of an accident.

The second risk coverage provides a limit calculated based on the value of the car, as in the case of a first relative risk, which can be integrated but also a franchise that can be quite high.

The policy Kasko a second risk is a further possibility, which is still cheaper than the first risk, to enter into a Kasko convenient to economic conditions. While the total value Kasko cover any damage to the vehicle, without imposing a ceiling on the first and second risk guarantee the vehicle during the road, but only for damages which are below a threshold limit.

The special policy to second risk is that combining the limitation of the ceiling to that of a franchise. Specifically, the conditions of a policy on a first loss in more of a relief: the damages that are recovered are those between the ceiling and the franchise. The ceiling of policies according to risk is calculated in the same way as that of the first bills to risk the premium is based on a percentage calculated on the commercial value of the vehicle. The percentage, in contrast to that expressed in absolute terms, changes to changes in the value of the vehicle: i.e. it will decrease over the years, due to the loss of value that the vehicle undergoes over time. Thus, decreasing the value of the car also decreases the amount of compensation, calculated precisely, as a percentage.

The relief, in general, is that part of the repayment of a loss which is borne by the insured. Under the policy of civil liability for driving cars, the franchise is part of a damage caused to third parties who will reimburse the insured. In reality, the victim can always call into question the insurance company for compensation and the company is obliged to compensate the damage, regardless of the franchise. It will then ask the insurer to its insured and receive in turn be reimbursed for the portion of harm for which the insured under its policy was not guaranteed compensation.

In insurance policies you may have an excess absolute or relative.

Relief is on the clause that clearly differentiates the damages exceeding the amount corresponding to the franchise from those who are below the deductible.

In policies of liability insurance for cars, the relief is that part of compensation for damage caused to third parties that the insured person must pay the injured person or in any way to return to his insurance company.

In the case of relief on, whether you cause an accident, and his damage is below the deductible, the insured will be obliged to compensate for their own pockets. The cost of policies with deductible on then is that we are obliged to claim the exemption only if the incident is minor, whereas in the case of an accident more severe, the compensation is total, and is not deductible longer taken into account. Even if the clause is less widespread relief on Italian insurance market, the franchise is on the ideal solution if you want to use this threshold as the limit within which agrees indemnify the insured directly without involving the insurance company. Within the limits of damage on the franchise, the company is not liable for damages, so definitely not go through the process of termination of the insurance claim, a procedure that would only worsen the effect of their status within the class merit bonus. In fact, bills with franchise can also be entered into with the bonus system (with bonus deductible).

The absolute relief, it is the insurance deductible clause most commonly used on the Italian market. The relief in an insurance policy for auto liability insurance is that part of compensation that remains to be borne by the insured which caused the damage. The relief is absolutely always paid by the insured, regardless of the extent of the damage caused in the traffic accident and differs from the relief on because it does not change depending on the extent of damage or not exceeding the limit of exemption clause.

In general, however, in policies R.C. auto complete relief varies from a minimum of 200 to a maximum of 500 euros. The relief is now complete, generally expressed in absolute terms, but may also find it expressed as a percentage compared to the damage of the traffic accident. We need to do calculations to verify the convenience of an absolute exemption. Because if it is true that the premium for a policy with franchise can cost up to 15% less, an absolute exemption of 500 euros can then definitely nullify the savings. Ultimately, policies are in with a solution especially if you are particularly convinced that the drivers drive safely, with less likely than the average, to cause accidents.

Generally, the insurance premium is lower in absolute policies with deductible and higher in policies relating to relief. This stems from the fact that in absolute relief to policyholders, the portion of the damage within the deductible is always and however be borne by the insured, while on the relief, if the damage exceeded the threshold of the exemption, the compensation would be entirely borne by the airline and insurance should not pay anything.

Both as regards absolute relief that on the insured, when concluding the policy is always obliged to give the necessary guarantees to its insurance company for the return of the franchise itself.

Bills of liability car may only be a deductible (without the mechanism of the bonus) or combine with the bonus relief.

In an insurance liability for ceiling means the maximum amount that can be compensated for damage caused to third persons. Beyond that level, is the insured to meet in person and pocket for all damages that resulted. As you can well imagine this is poor, from which we can trial detention raising the premium payable.

For the old law, the minimum limit that the insurance companies had to ensure that compensation was equivalent to 750mila euro, established by law on the RC car of 1969. Today, after 40 years, this amount may not suffice to cover all damages caused in an accident. The ceiling provided by law in Italy is among the lowest across the EU. Indeed, in case of accidents involving deaths or serious injuries, the calculation of property damage, biological and moral drawn from the judiciary, can be very high, sometimes well above that figure. In particular, the damage is proportional to income to which the injured person was not, and can be very substantial. Indeed, today the scales are of 1 million euros for damage to property and 5 million for damage caused to people.

To reach and exceed the ceiling contribute only the costs due to the victims of the accident, and therefore can not be counted to determine the cost responsibility, such as legal fees or court costs. However, all companies offer the opportunity to enjoy a higher ceiling, paying proportionally a higher insurance premium. Some companies, not all provide the opportunity, against payment of a premium rather high, to be guaranteed in any amount of compensation which could amount to damage, and no ceiling.
